EY: Changes to childcare entitlement regulations following removal of Overall Effectiveness judgements from state schools: DfE

See update from the Department for Education:

The regulation changes that were previously outlined were laid in Parliament at the end of November are due to come into effect on 20 December 2024.  

The regulations governing the childcare entitlements currently enable LAs to refuse to make arrangements with, or terminate funding for, providers judged ‘inadequate’ by Ofsted for their overall effectiveness for all entitlements or ‘requires improvement’ for overall effectiveness for the disadvantaged 2-year-old entitlement.

The new regulations will provide an alternative trigger for state schools (including maintained schools, maintained nursery schools and academies) inspected after 2 September 2024, because these providers will no longer receive an Overall Effectiveness (OE) judgement.  

There are no changes to Ofsted grades for childminders or Private, Voluntary and Independent providers at this stage, or for state schools whose most recent inspection took place before 2 September 2024. As now, the regulations and statutory guidance will continue to refer to OE judgements for these providers, and for all schools whose most recent inspection report includes an OE judgement.
